2016 Membership Drive Official Rules
1. Who is eligible?
All residents who are 21 years or older as of March 1, 2016 who join or renew their membership and those who register with IMBA or sign up to receive IMBA e-news during the campaign period are eligible. No purchase required to enter or win. Donation does not increase odds of winning. This promotion is an incidental benefit for supporters of the International Mountain Bicycling Association (IMBA) only, as registered in the organization’s database.
This promotion is void where prohibited under state and/or federal law. This promotion is void in the states of Florida, New York, and Rhode Island. All entrants must have a record in the database to be considered. Employees of the International Mountain Bicycling Association (IMBA) (the Promoter), IMBA-affiliated chapters, their subsidiaries and affiliates, or of other companies associated with the promotion of the drawing, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible.
Opt-In Communications: By entering donors and registrants give permission to add his/her registering email address to the Promoter and the Sponsors’ databases and will receive email communications from those organizations. Donors/Registrants may opt out of these email communications at any time.
2. Who is sponsoring the drawing?
- This drawing is for the benefit of IMBA and its members, 4888 Pearl East Circle, Suite 200E, Boulder, CO, 80301 (the “Promoter”).
How do I enter?
The promotion runs from 12:00 am (MDT) on March 1, 2016 to 11:59 p.m. (MDT) on December 31, 2016 (the “Entry Period”). During the Entry Period, there are five ways to enter: Method 1: Complete a membership contribution online IMBA at imba.com/join. Method 2: Complete and mail a direct mail membership appeal response in the reply envelope provided. Method 3: Add your name, email and zip code to a printed entry form at an event where IMBA or an IMBA-affiliated chapter is exhibiting. Method 4: Handprint the entrant name, physical address and email address on a postcard and mail to: IMBA 2016 Spring Membership Drive, 4888 Pearl East Circle, Suite 200E, Boulder, CO, 80301. All mail-in entries must be received by January 7th, 2017 to be included in the pool that we will choose from for prizes at the end of the Entry Period. Method 5: Complete the form at imba.com/trail-love with your name, email and zip code.
3. How will winners be selected?
On the 8th day of the month following the campaign, or the next business day, in 2016, a representative from IMBA will select a potential winner for each prize in a random selection of all entries received during each respective campaign period. Entries from states where the promotion is prohibited are void and will not be included in the drawing. The odds of winning depend on the number of eligible entries received. Each potential winner will be notified on the 6th of the , and the winner must respond and confirm availability to participate within 48 hours or a new winner will be selected for that specific prize.
4. What can I win?

Any prize details not specified above will be determined by the Sponsor in its sole discretion. Prizes are not transferable and must be accepted as awarded. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by the Sponsor in its sole discretion. The winner is responsible for paying taxes, filing appropriate tax documents declaring the value of the prize, and any and all other costs and expenses not listed above or on the Promoter’s web site.
5. What may a potential winner be required to do?
Except where prohibited, a potential winner may be required to complete and return a Declaration and Release and/or tax form W-9, if applicable, within five (5) days of being notified. If a potential winner declines to accept the prize, has violated any of these Official Rules, or fails to sign and return the required documents within the required time period, then an alternate entrant will be selected in his/her place in a random drawing of remaining entries. The trip winner is encouraged to post social media highlighting photos of the trip.
What other terms should I be aware of?
By participating in the drawing, entrants agree to be bound by these Official Rules and the determinations of Sponsor, which shall be final. Unless prohibited by law, entrants agree to allow use of their name, voice, city/state of residence, photograph, and/or likeness for advertising and/or trade and/or any other purpose in any media or format now or hereafter known without further compensation, permission or notification.
This benefit is subject to federal, state, and local laws and regulations and is void where prohibited by law. In the event that the operation, security, or administration of the benefit is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor and Promoter may, in their sole discretion, either: (a) suspend the promotion to address the impairment and then resume the promotion in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize at random from among the eligible entries received up to the time of the impairment. The Sponsor and Promoter reserve the right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the drawing or to be acting in violation of these Official Rules or in a disruptive manner. Any attempt by any person to undermine the legitimate operation of the drawing may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor and Promoter reserve the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor or Promoter to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor and Promoter reserve the right to modify or cancel this promotion at any time and, in the event of cancellation, substitute another in its place.
Participation is limited to IMBA constituents that are registered with a record in IMBA’s database. By participating in the promotion, constituents agree to release and hold harmless the Promoter, the Sponsor, and any related organizations’ employees or volunteers, and their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the drawing or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the drawing; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the promotion or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the promotion or receipt or use of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the promotion, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
6. How will disputes be handled?
Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Colorado. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Promoter or Sponsor in connection with the promotion, shall be governed by, and construed in accordance with, the laws of the State of Colorado, without giving effect to any choice of law or conflict of law rules (whether of the State of Colorado or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Colorado.
7. How can I find out who won?
To obtain the name of the winner, send a self-addressed stamped envelope to: IMBA 2015 Fall Membership Drive, 4888 Pearl East Circle, Suite 200E, Boulder, CO, 80301. Requests must be received within four (4) weeks of the conclusion of the Entry Period.
