We suggest patrols purchase additional coverage for special events where a fee is charged and the public is invited. No additional coverage is needed for special events when no fee is charged and only members are invited. Typical patrol activities such as meetings, group rides, and trailwork sessions are covered under the regular policy.
IMBA receives no compensation or consideration from McKay Insurance. Dan McKay is an individual IMBA member and McKay Insurance is recognized in IMBA materials as a Corporate Supporter.
IMBA encourages all race organizers (whether they are IMBA-affiliated patrols or not) to sanction and insure their races through NORBA.
Dan McKay and McKay Insurance has been working with IMBA since 1995 to protect mountain bike Patrols from liability concerns. Since that time, he has become an expert on all matters of bicycle liability and is recognized as a supporter of trail advocacy efforts nationwide.

Yes. Each situation is different and we would want to talk with each patrol about the need for the additional coverage. We can accommodate most requests for additional coverage, if given adequate lead-time (30 days).
Our policy provides legal liability coverage for negligent acts for the following groups:
Yes, the third party liability that a patrol incurs would be covered by the policy. If a member were named as a party to the action, they would also be covered. If a non-member were to cause damage or injury, the Patrol would owe that non-member no duty to defend them for their actions. If the non-member were to allege that they were acting at the direction of the patrol, its officer, director or member, then the patrol would have coverage if it were named in a lawsuit. The patrol is always covered in the event a third party action is brought alleging negligence.
Members injured while participating in a patrol activity have the right to bring suit against the patrol. The patrol would be defended and all sums awarded would be paid up to the limit of the policy.
The General Liability policy covers third party claims for loss caused by the negligent act of the insured. If the patrol chooses, it may purchase, for an additional premium, accident medical expense excess coverage for its members and volunteers. We highly recommend this coverage to assure that your volunteers and members can be compensated if they are injured while participating in a patrol activity.
Keep in mind that liability requires negligence on the part of the insured. Also, an accident medical policy is paid regardless of who is at fault or who contributed to the situation.
We would need specific details of the event to make a determination on insurance type. Generally, if you were charging a membership fee as a means of simply avoiding liability or premium for an event, you would be charged a premium for your special event. Patrols should carry both liability and accident medical coverage for the special event!
If, on the other hand, it is truly an event that is open to members only, and you require all that participate to be members, then there would normally be no premium for coverage to apply. When in doubt, call your agent!
We currently use the standard insurance certificate that is approved by all agencies of the Federal Government. Our form is a standardized form used by 90% of the insurance companies in America. If specific coverage details are needed by the certificate holder, refer them to the agent for clarification of exactly what is needed.
In the past two years we have been successful in getting our form approved in every U.S. Park Service District. The form is purposely simplified to assist in keeping the cost to our insured members low.
Yes! Please send us your name and address and we will provide you with a coverage brochure that has been newly created for this year's renewal. Our coverage is the industry standard, and we have added a few endorsements that enhance the coverage for patrols. A few examples include members as additional insured, broad form liability endorsement, Good Samaritan coverage, host liquor liability and contractual liability.
Special events are insured for the patrol automatically, as long as they are reported to our office prior to the event. Patrols should call, fax or email the agent with the following information:
Based on these materials, we can estimate the premium for the event and quote the options that are available.
We provide liability insurance, including "Participant Legal Liability", and accident medical expense for the participants. The cost is based on the number of participants and days of the event. We have a set minimum premium that is per policy year, not per event. Our policy also provides coverage for Participant Legal Liability (PLL). PLL is the most often excluded coverage in other policies that we have reviewed for member Patrols. We usually can provide coverage with PLL for a lower premium than other policies that exclude the PLL coverage.
If seeking coverage for a race, the patrol should contact NORBA for information about their race coverage policy. NORBA is one of IMBA's biggest supporters, providing funding to the Trail Tune-up Grant Program.
We are currently negotiating coverage for Canadian patrols with two Canadian insurance brokers. It appears that we are making some headway and expect to have a firm program soon. Contact us for details. 1-800-942-0283.
