Clarification of IMBA Club Insurance in Canada

McKay Insurance Agency, Inc. currently provides liability and accident medical insurance coverage for IMBA-affiliated clubs in the U.S. and Canada. Clubs must be current members of IMBA, complete an application, and pay the appropriate premium in U.S. dollars. Coverage is provided by a Master Policy issued to the Colorado-based International Mountain Bicycling Association (IMBA) and its affiliated clubs. The policy has a coverage territory of "The United States of America (including its territories and possessions), Puerto Rico and Canada (emphasis added): International Waters and all other parts of the world - Provided the insuredıs responsibility to pay damages is determined in a "suit" on the merits, in the territory described in the first sentence above (US, territories and possessions, Puerto Rico and Canada (Emphasis added).
Lawsuits brought in Canada are covered by our current policy. Disagreements on the settlement of claims or coverage would be arbitrated in the State of Colorado, where the Master Policy is held.
IMBA-affiliated clubs in Canada do not have the protection of their provincial Financial Services Office. Similarly, IMBA-affiliated clubs outside Colorado do not have the protection of their State Insurance Departments. All clubs have the protection and services offered by the Colorado Insurance Department.
