What would we do without trails?

IMBA CANADA Affiliate Club Insurance Program(s) FAQ'se

Q: WHAT POLICIES DOES IMBA CANADA OFFER THROUGH OASIS INSURANCE?
A: There are 3 different insurance programs. General Liability, Directors and Officers and Group Accidental Death and Dismemberment insurance.

Q: DOES OUR CLUB HAVE TO BE AN IMBA AFFILIATE IN ORDER TO QUALIFY?
A: Yes, except for Directors & Officers insurance. General Liability and Group Accident is exclusive to IMBA Canada Affiliate Clubs in good standing.

Q: DOES OUR CLUB HAVE TO BE AN INCORPORATED SOCIETY TO QUALIFY?
A: Only the Directors and Officers insurance requires the club to be incorporated by the province in which the club resides.

GENERAL LIABILITY

Q: WHAT DOES THE GENERAL LIABILITY POLICY COVER?
A: It covers all activities necessary to conduct the day to day operations of operating the club, including events such as meetings, club rides, trail construction, development or maintenance of trails built to ³Whistler Trail Standards², fund raising events, hosting non-competitive events and other club activities. It also provides coverage for participants in sanctioned club events up to a limit of $ 10,000 where legal liability is not required.

Q: WHO DOES IT COVER?
A: All participants of the certificate holder including employees and volunteers, sponsors and owners of facilities in whose name you have agreed to provide vicarious liability.

Q: WHAT IS NOT COVERED?
A: Race, speed events, contests or practices (if you are not sure, call toll free to 1 888 539 2485 before the event); sexual molestation or abuse; absolute pollution; host liquor and/or forcible ejection. Please refer to policy wording for complete details. It can be requested from IMBA or OASIS.

Q: WHAT IS THE LIMIT AND DEDUCTIBLE?
A: The limit of liability is $ 5,000,000 per occurrence and general aggregate. This includes cost of investigation and defense of such claims. The deductible is $ 1,500 per claim. Higher limits are available upon request, however will require at least 10 working days to arrange terms.

Q: HOW IS OUR PREMIUM DETERMINED?
A: Your premium is based on membership at a cost of $ 13. per member. Premiums are not retroactively adjusted for growth. You pay based on membership at the time of applying. There is no premium determination on the number of kilometers of trails operated.

Q: WHEN IS COVERAGE IN FORCE?
A: Coverage is in force for 12 months from the date a completed application is received and accepted. There is no mandatory expiry date on the master policy.

Q: WHO IS THE UNDERWRITER?
A: Certain underwriters at Lloyd's.

Q: IS THERE A STANDARD TO WHICH THE CLUB MUST MAINTAIN TRAILS AND TTF'S?
A: The General Liability program will insure TTF's (technical trail features) built to ³Whistler Trail Standards² as described in the ³Resort Municipality of Whistler's First Edition, Environmental and Technical Trail Features² document.

Q: IF OUR CLUB HAS ENTERED INTO AN AGREEMENT WITH THE LAND MANGER AND WE DISCOVER UNAUTHORIZED TRAILS AND/OR TTF'S, WHO IS LIABLE FOR INJURIES ON THESE TRAILS AND STRUCTURES?
A: Once your club becomes aware of unauthorized trails or structures, it is your responsibility to notify the land manger in writing, as soon as possible. A dialogue between your club and the land manger should be developed to either decommission or redesign the trail or TTF. Remember TTF's must meet the ³Whistler Standards² document and trails should be sustainable.

Q: WHAT DO WE DO ABOUT TRAILS AND TTF'S THAT DO NOT MEET THE CRITERIA LISTED IN THE ³WHISTLER STANDARDS² DOCUMENT?
A: Upon signing an agreement with the land manager an audit of the trails and TTF's is your first step. Volunteers can only do so much in a given time so your club will have to discuss with the land manger which TTF's or trails need immediate attention. Some trails or TTF's may have to be decommissioned before they can be upgraded.

DIRECTORS AND OFFICERS ERRORS AND OMISSIONS

Q: WHAT IS DIRECTORS AND OFFICERS INSURANCE?
A: Directors & Officers insurance protects against claims usually brought by other members alleging loss or damage arising from mismanagement of the entity, or other wrongful acts. These incidents are typically excluded from the Comprehensive General Liability, as they do not involve a bodily injury or property damage incident.

Q: WHAT ARE THE LIMITS AND PREMIUMS?
A: There are optional limits of $ 1, $ 2 or $ 5,000,000. Premiums are as low as $ 250 for a year. Details can be found at www.oasisinsurance.ca.

ACCIDENTAL DEATH AND DISMEMBERMENT

Q: WHAT IS GROUP ACCIDENT AND WHAT DOES IT COVER?
A: Group Accident protects against injury caused by an accident occurring while on a business trip and while performing administrative duties. The coverage can also be extended to volunteers where an accident might occur while performing their assigned and supervised volunteer duties, including fund raising, constructing, developing or maintaining a trail.

Q: WHAT ARE THE LIMITS AND PREMIUMS?
A: The principal sum is $ 100,000. Premiums are $ 16.50 per Director, minimum $ 150. Volunteers at $ 2 per volunteer per year, minimum $ 250 (director and volunteer total). Applications are available at www.oasisinsurance.ca.
